Dr. Norbert Gass and Nicole Gass explained that technology transfer from the developed to the developing world (the blunt edge of the sword) was not adequately structured in the 1990s. A widening technology gap was being generated. A better legal framework was sorely needed.
The transfer of technology from advanced countries to developing ones is a key element in economic development. However, the legal issues with patents, trademarks, ownership right and so on pose great problems and could lead to conflicts with national sovereignty and development policies in receiving countries. This paper analyzed and compared the problems of two major players: OECD and UN Conference on Trade and Development. Their guidelines for transfers were inadequate and more needed to be done soon to stop the widening of the technology gap between advanced and developing nations.
